Terms & Auction Conditions

These terms apply to auctions run on fateseeker.art by Glintworks e.U., Hamerlingstraße 7, 4020 Linz, Austria (business@fateseeker.art), referred to below as “the seller”. Full company details are in the Imprint. “You” means anyone registering to bid.

These terms don’t affect any consumer protection rights you have under mandatory law in your country of residence.

1. Registering to bid

Bidding requires registering with a working email address and confirming it via the link we send you. One registration per person; registering on behalf of someone else, or with intent not to pay, is not allowed and can get a registration revoked. You must be 18 or older and have full legal capacity to bid.

2. How the auction works

• You enter the most you’re willing to pay (your “maximum”). We bid on your behalf in increments of the minimum step shown on the auction page, only as high as needed to keep you in front of the next-highest bidder. We never bid more than your own maximum, and we never reveal it to anyone, including other bidders. If your maximum doesn’t clear the next-highest bidder’s maximum by a full increment, the displayed price is capped at your maximum instead of jumping a full increment ahead, so two bidders can briefly show the same or a less-than-one-increment-apart price without their true maximums being equal.
• You can raise your maximum at any time before the close, but you can’t lower it or withdraw it.
• The highest maximum standing when the auction closes wins. There is no reserve price. If two bidders enter the same maximum, whoever reached it first wins.
• A bid placed inside the extension window shown on the auction page (currently the last few minutes before the scheduled close) rolls the closing time forward to that same interval after the bid, so a late bid can’t win purely by timing. Repeated late bids can keep extending the close.
• Bids are binding and can’t be withdrawn. If you raise an obvious input mistake (for example a typo adding a digit) before the final hour of the auction, we’ll normally correct or cancel that bid. This is separate from, and doesn’t limit, your statutory right to contest a bid made in genuine error under applicable law.

3. What winning means

The price you pay if you win is the current bid at the moment the auction closes: one increment above the next-highest bidder’s maximum, and never more than your own maximum (if you had no competing bidder, it’s the starting bid). The purchase contract is formed automatically at that moment: closing with the highest standing maximum is the seller’s acceptance of your bid, and you’ll receive an email confirming this within minutes. An Etsy listing set to your winning amount follows, for payment only. Etsy processes that payment and provides its own buyer protections, but the seller remains the contracting party and these terms still apply to the sale.

4. Payment

Payment (card or PayPal, via the Etsy listing) is due within 5 days of receiving the Etsy listing link. If payment still hasn’t cleared after we’ve given you a reasonable further chance to pay, the seller may withdraw from the contract. In that case the seller may then offer the item to the next-highest bidder as a new sale, and may decline to sell to you in future auctions. This doesn’t limit any other remedy available to the seller under applicable law.

5. Shipping

• Shipping is insured and tracked, and posted within 3 working days of payment clearing.
• Shipping cost depends on destination and package weight. Before you bid, the auction page shows an estimated cost for a range of countries; the exact cost is then quoted individually on the Etsy listing after you win, based on your actual destination and package weight.
• Outside the EU you may owe import duty or VAT on arrival. That cost and any customs formalities are your responsibility, not the seller’s.

6. The item

Each auctioned piece is hand-cast and hand-finished individually, not mass-produced, so small variations in weight, edge, and finish compared to the photos are normal and not a defect. Your statutory warranty rights (Gewährleistung) for a genuine defect are unaffected and can’t be excluded by these terms: as a consumer, you have a 2-year warranty period from delivery, and for the first year any defect is presumed to have existed at delivery unless we show otherwise. Unless stated otherwise, items are collector’s pieces not intended for children under 14, as they contain small parts and are not a toy.

7. Right of withdrawal

As a consumer you have a statutory right to withdraw from the purchase. See our Right of Withdrawal notice for the full terms, deadline, and how to exercise it. This applies to the sale regardless of which checkout the payment runs through.

8. Electronic contracting

• Before you submit a bid, you’ll see a confirmation screen showing the exact amount. Use it to catch and correct any input mistake before the bid is placed.
• We store the record of your registration, bids, and any resulting contract, and can send you a copy on request (see our Privacy Policy).
• Contracts can currently only be concluded in English.
• We don’t subscribe to any code of conduct for this auction.

9. Governing law & disputes

These terms are governed by Austrian law. If you’re a consumer resident in the EU, this doesn’t take away any protection you have under the mandatory consumer-protection law of your own country of residence.

We are not obliged and currently do not take part in dispute resolution proceedings before a consumer arbitration board.

10. If a clause turns out to be invalid

The rest of these terms stay in effect. Where a clause is invalid, the relevant statutory provision applies in its place.
